Terms of Service

1. Acceptance

By creating an account or using TheHinter (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and TheHinter.

2. The Service

TheHinter is an AI-powered email warmup service. It connects to your Gmail account via OAuth and automatically sends and receives low-volume warmup emails to build your sender reputation over time, improving email deliverability.

3. Eligibility

You must be at least 18 years old and have the authority to bind yourself (or your organisation) to these terms. The Service is intended for business use.

4. Account & Gmail access

  • You authorise TheHinter to send and read emails via your Gmail account solely for the purpose of email warmup as described in our Privacy Policy.
  • You are responsible for keeping your account credentials secure and for all activity under your account.
  • You may revoke Gmail access at any time via Google Account Permissions. Revocation stops the warmup service.

5. Acceptable use

You agree not to:

  • Use the Service to send spam, phishing, or illegal content.
  • Attempt to reverse-engineer, scrape, or abuse the Service.
  • Use the Service in violation of Google’s Terms of Service or Gmail policies.
  • Resell or sublicense access to the Service without written permission.
  • Use the Service for any unlawful purpose.

6. Subscription & billing

  • The Service is billed monthly at the rate shown at checkout. Prices may change with 30 days’ notice.
  • Payments are processed by Lemon Squeezy. We do not store your payment details.
  • Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial months, except where required by applicable law.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or suspend the Service for technical or legal reasons. We will notify you of planned downtime where reasonably practicable.

8. Disclaimer of warranties

TheHinter is provided “as is” without warranties of any kind. We do not guarantee specific improvements to deliverability, inbox placement rates, or email performance. Results vary depending on your email provider, sending history, and content.

9. Limitation of liability

To the maximum extent permitted by law, TheHinter’s total liability to you for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate your account for violation of these terms, non-payment, or if required by law, with reasonable notice where possible. You may cancel your account at any time from your dashboard.

11. Changes to terms

We may update these terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of California.
